Decreto nº 11.795 de 23/11/2023

Decree 11.795, of November 23, 2023, regulated Law 14.611/2023, which provides for equal pay and remuneration criteria for women and men.

The measures set out in the Decree are aimed at private companies with 100 or more employees that have their head office, branch or representation in Brazil, whether incorporated in fact or in law. These companies will be obliged to publish a Salary Transparency and Remuneration Criteria Report, the purpose of which is to objectively compare salaries and the proportion of positions held.

The Reports must be published in March and September, as established in an act to be published by the Ministry of Labor and Employment.

If the Ministry of Labor and Employment finds that there is a wage gap between women and men, companies must devise and implement an Action Plan to Mitigate the Wage Gap and Pay Criteria between Women and Men.

The data and information included in the Reports must be anonymized, with due regard for the protection of personal data, and submitted through a digital tool made available by the Ministry of Labour and Employment.
