New CNJ provision allows transgender Brazilians living abroad to change their names in consulates and embassies

Since June 2022, through Provision 73 of the National Council of Justice (CNJ), any Brazilian over 18 years old can request the adjustment of their self-perceived identity on their birth or marriage certificate directly at the Civil Registry Office where the act was registered. However, Brazilians living abroad were unable to exercise this right.

In front of this situation, to ensure dignity for transgender individuals, CNJ issued Provision 152, published on September 26, 2023, enabling Brazilians residing abroad to change their name and gender before a Brazilian consular authority, without the need for a judicial process. After the request, the consulate itself will forward the procedure to the respective Civil Registry Office.

The measure is valid for natural-born and naturalized Brazilians, without the need for any gender reassignment surgery. The request will require the presentation of a declaration indicating residence abroad for more than 5 years, accompanied by documentary proof, among other documents and certificates.

After the annotation and change in the record, the Registry Office will notify the issuing authorities of the ID card, CPF (Brazilian taxpayer registry), voter ID, and passport, for the issuance of new documents.
