Changes related to Labor Claims in eSocial

The eSocial (government system for transmission and storage of labor and social security information on companies and Workers) has undergone significant changes in recent years. The last major change occurred in July 2021, when the Simplified eSocial went into effect.

One of the main changes in the new system is the reduction in the number of events and fields that need to be filled out by employers.

However, not everything has been simplified. As of April 1, 2023, companies will be required to report any settlements and labor sentences against them, including cases in which they are held subsidiary liable, in event S-2500 – Labor Claims. The deadline for sending this information is the 15th day of the month following the final and unappealable decision or judicial homologation.

With the inclusion of information about labor lawsuits in eSocial, the declaration of social security and social contributions due as the result of a court conviction or agreement is now mandatory in event S-2501 – Information about Contributions Resulting from Labor Lawsuits. The deadline for sending the information is up to the 15th day of the month following the payment of the conviction or agreement.

It is essential that the companies are aware of these changes, making the necessary corrections and adjustments in their internal processes to ensure compliance with the new obligations. It must be emphasized that non-compliance may result in sanctions, administrative fines, and lawsuits to the companies.
