A regulamentação do instituto do Trust no Brasil, através do Projeto de Lei (PL) nº 4.758/20, foi aprovado pela Comissão de Finanças e Tributação e pela Comissão de Constituição e Justiça da Câmara dos Deputados.
O PL define conceitos importantes na esfera cÃvel, mas não traz definições sobre tributação. Contudo, é provável que definições tributárias sejam tratadas na sequência, de forma a proporcionar certa segurança jurÃdica aos contribuintes sobre o tema.
O Trust é um contrato privado proveniente de paÃses anglo-saxões, muito comum no exterior, onde o seu instituidor (settlor) transfere a propriedade (parcial ou total) de determinados bens para um agente fiduciário (trustee), que fica responsável pela administração e pela destinação destes, conforme definido pelo instituidor, podendo ter como beneficiários herdeiros e o próprio instituidor.
O projeto aguarda o prazo para interposição de recurso ao Plenário da Câmara e, não havendo, seguirá direto para o Senado, para votação.
