Em linha com as alterações trazidas pela Emenda Constitucional 123/23, também conhecida como reforma tributária, aprovada no fim do ano passado, a Assembleia Legislativa do Estado de São Paulo propôs o Projeto de Lei 7/2024 (“PL”), o qual visa instituir alíquotas progressivas para a tributação do Imposto sobre a Transmissão “Causa Mortis” e Doação de Quaisquer Bens ou Direitos (“ITCMD”). As alíquotas em questão serão de 2% a 8%, a depender do montante da transmissão.
Cumpre destacar que, caso aprovado, o efeito das alterações trazidas pelo PL deve seguir a anterioridade nonagesimal e anual.
Neste sentido, entendemos que se trata de um momento importante para os contribuintes refletirem sobre a viabilidade de se realizar eventuais doações e antecipações de legítimas, ainda sobre a vigência da alíquota fixa para o Estado de São Paulo de 4% sobre o valor do bem transmitido.
