O Decreto 11.322/2022 assinado pelo presidente em exercício e publicado em 30 de dezembro diminuiu as alíquotas de PIS e COFINS sobre receitas financeiras para empresas sujeitas ao regime não-cumulativo, com vigência a partir de 01 de janeiro.
Dessa forma, a alíquota de PIS passou para 0,33%, ao invés de 0,65%, e o percentual da COFINS foi para 2%, em contrapartida aos 4% anteriores.
Todavia, através do Decreto nº 11.374/2023, publicado extraordinariamente dia 2 de janeiro, o Governo atual revogou as reduções e restabeleceu os 0,65% e 4%, com vigência imediata.
O novo decreto pode ter violado o prazo de anterioridade de 90 dias para o aumento da tributação, o que autorizaria o ajuizamento de ação judicial pelos contribuintes.
