A Receita Federal divulgou a Solução de Consulta Cosit nº 13/2018, na qual analisou o valor do ICMS a ser excluído das bases de cálculo do PIS e da COFINS para os contribuintes que foram vitoriosos no Poder Judiciário.
Em resumo, a Receita Federal decidiu que o montante a ser excluído é o valor mensal do ICMS a recolher, e não o total do ICMS destacado nas notas fiscais.
Para chegar a essa conclusão, a Receita Federal adotou uma interpretação descontextualizada de alguns trechos de votos dos ministros da Suprema Corte no julgamento do leading case sobre o tema (Recurso Extraordinário nº 574.706/PR).
Porém, alguns ministros já sinalizaram o entendimento de que o valor a ser excluído é o total do ICMS destacado nas notas fiscais, posição esta diversa da adotada pela Receita Federal.
Ressaltamos que a questão deverá ser definitivamente decidida quando da apreciação dos embargos de declaração opostos pela Fazenda Nacional no julgamento da Suprema Corte.
